  1. Biopatent is a biological patent awarded for strains of microorganisms, cell lines, genetically modified strains, DNA sequences, biotechnological processes, product processes, products, and product applications.
  2. Biopatents are awarded to recognize real innovative contributions made by the inventor to the cause of human welfare.
  3. The awards are given to inculcate encouragement and values in developing scientific culture and in emphasizing the role of biology in shaping human society.
  4. Indian patent allows ‘process patent’ and not the ‘product patent’. Biopatent allows the patent holder to exclude others from making, using, selling, or importing a protected invention for a limited period of time.
  5. The duration of biopatents is five years from the date of the grant or seven years from the date of filing the patent application, whichever is less.
