Question

The President is the nominal head of the executive, the first citizen of the country, as well as the commander-in-chief of the Indian Armed Forces. With reference to this, answer the following question:

Describe the procedure for the impeachment of the President.

Answer in Brief

Solution

  1. When a President is to be impeached for violation of the Constitution, either House of Parliament can level the charge as follows:
    1. Resolution which is moved after at least fourteen days' notice in writing signed by not less than one-fourth of the total number of members of the House.
    2. The resolution is passed by a majority of not less than two-thirds of the total membership of the House.
  2. When a charge has been so preferred by either House of Parliament, the other House will investigate the charge, and the President has the right to appear and be represented in such an investigation.
  3. If, as a result of the investigation, a resolution is passed by a majority of not less than two-thirds of the total membership of the House (by which the charge was investigated), declaring that the charge has been sustained, such a resolution will have the effect of removing the President from his/her office.
