Question
Briefly discuss the appellate jurisdiction of the Supreme Court of India in Civil matters.
Solution
- The Supreme Court is India's highest court of appeals for all civil and criminal issues. In this jurisdiction, one may appeal a decision from any High Court to the Supreme Court. It may uphold or overturn the High Court's decision. Its choice is final. After a hearing, however, a revision petition may be submitted, in which case the court may change its decision.
- According to Article 133 of the Indian Constitution, the Court must make a decision in cases involving appeal authority for civil actions if there is an important issue of law or if the decision is incorrect. The High Court grants the authority to file appeals with the Supreme Court in several situations.
